General Skill Migration visas

Partner category visas
If your Spouse is an Australian Citizen or Australian Permanent Resident, you can be eligible to migrate to Australia under Partner Migration category. Partner visas are not point tested but applicant needs to prove authenticity and continuity of their relationship. Even if you are not married but engaged to an Australian Permanent Resident or Citizen and would like to join him in Australia to get married there, you can apply for Prospective Marriage Visa

Partner visas are for Spouse, Fiancé or De facto partner (including same-sex relationships) of an Australian citizen, Australian permanent resident or eligible New Zealand citizen. Partner visas allow to live in Australia as a temporary or permanent resident.

Following are the options for Partner visa applicants applying from outside of Australia

  • Partner (Provisional) Visa and Permanent Visa
  • Prospective Marriage visa

Partner visa is a two stage visa option where initially the applicants are applying for the Partner (Provisional) visa which is the first stage visa and then in two year time, department will invite to applicant to proceed for second stage application i.e. permanent Partner visa (subclass 100). Applicants only need to lodge one application and need to pay one application charge only for both stages visas.

The Prospective Marriage visa is a nine months temporary visa for people who want to go to Australia to marry their prospective spouse. Once married, the applicant can further apply for partner visa if meeting all the requirements.

For all partner category visas, applicant must prove that their relationship is genuine and ongoing relationship, and there must be freely consent to the relationship from both partners. Applicants must meet health and character requirements before their visas can be granted.

Spouse visa application can be also be made before marrying the intended partner if applicant intends to marry the partner before a decision on visa application is made.

Other Family Migration Visas

Parent visas

This category visas are for parents who have an Australian Citizen, Australian Permanent Resident or an eligible New Zealand citizen usually living in Australia, are able to satisfy balance test along with the other criteria relevant to particular parent visa class. In order to apply for parents visas, parents must be sponsored by eligible child and must also meet health and character requirements.

Parent visa stream has both temporary and permanent visas where the temporary visas allows the holders to live in Australia for up to 2 years as a temporary resident and permanent visas allow the holders to live in Australia as a Permanent Resident.

All applicants for a parent visa must meet the balance of family test i.e. at least half of applicant’s children live permanently in Australia, or more of applicant’s children live permanently in Australia than in any other country.

Parent visas are divided in two streams.

  • Normal Parents visas (Parent Visa (subclass 103) and Aged Parent Visa (subclass 804)

Normal parent visas are low cost visas but can take up to 30 years to be granted.

  • Contributory parents visas

These visa options are much quicker and can be granted in about two year time from lodgement but the applicants are required to pay higher visa application charges.

Assurance of support is required in both stream visas. An assurance of support is a legal commitment from an individual or organisation to give financial support to the applicant so he/she does not have to rely on social security payments. In case of normal parent visa, assurance of support duration is of 2 years whereas in case of contributory parents visa, it is required for 10 years.

Child Visa

Child visa is for applicant who intends to live permanently in Australia with his/her parent/s who is either Australian permanent resident or Australian citizen or eligible NZ citizen.

In order to apply for this visa, child must be less than 18 years old, single and must be dependent on his/her parents. The child must be sponsored by eligible parent. A child between 18 and 25 years of age can also apply if he/she is a fulltime student, single, not working fulltime and not having a disability which prevents him/her from working in future. A child more than 18 years of age can apply at any age if he/she is having a disability which makes him/her financially dependent on parents.

Orphan Relative visa

​​​This visa is for a child to travel to and live permanently in Australia with their sponsoring relative because either he/she is orphan or his/her parents are permanently incapacitated to care of the child. Child must be younger than 18 years of age, single and must be sponsored by a relative who is an Australian citizen, permanent resident or eligible New Zealand citizen.

Remaining Relative visa

This visa is for person who want to live in Australia to be with their only near relatives. This is a permanent visa and in order to be eligible to apply for this visa, you must prove that yours and your partner’s only near relatives are settled in Australia and are all Australian citizens, Australian permanent residents or eligible New Zealand citizens.

Applicant must be sponsored by one of the eligible near relative. A near relative is applicant’s parent or applicant’s partner’s parent (including biological and step-parent), brother, sister, stepbrother or stepsister and non-dependent child or step child.

Visitor’s visa

Visitor’s visa is for people who want to visit Australia for short stay of up to 12 months as tourist or as a business visitor or to visit family member in Australia. The visitor visas are usually given for up to three, six or twelve months except in case of eligible parents where longer stay visitor visas may be given.

In case of a parent or step-parent of an Australian citizen or permanent resident or an eligible New Zealand citizen, department may grant visa up to 18 months, three years or five years with multiple entry. But in this case the visa holder can stay for maximum of 12 months in any 18 months period and it is must to hold comprehensive medical insurance.

​Depending on your visa conditions, you may be able to visit Australia only once or more than once during the validity of your Visitors visa. Visitor visa holders are not allowed to work in Australia and are not allowed to study for more than 3 months in Australia.
